Texas Car Crash Facts And Figures
The Texas Department of Transportation releases annual reports showing vehicle crash statistics in the state. These reports help us understand accident causes and trends. Here are highlights from the latest release:
- In 2015, there were 13,616 serious injury crashes in the state, causing serious injury to 17,011 people.
- In the same year, the total number of persons who obtained a vehicle crash injury, serious or otherwise, was 246,335.
- There were 3,531 deaths from motor vehicle accidents that year.
- Of those fatalities, 960 occurred in traffic accidents where alcohol was involved.
- Further, 476 of the fatalities occurred in accidents involving distracted driving.

Texas Auto Accident Laws You Need To Know
Following your car wreck, you should remember these laws and rules as they can greatly affect your case:
The “fault” system
Under the “fault” insurance system, the person who causes the accident is required to pay for it. This allows you, the injured, to claim compensation from that person’s insurer or to go to court and sue that person. By contrast, in “no-fault” states, the victim’s own insurer would have to cover the losses regardless of who was at fault in the crash.
The modified comparative fault rule
This rule applies if it is found that you are partially at fault in the accident that injured you. In that case, your damages award (the amount you receive) would be reduced based on how much of the fault was yours. For example, if your total accident losses amounted to $100,000 but the jury found that you were 20 percent at fault, the amount would be reduced by 20 percent, so you would receive only $80,000.
Further, this only applies if your fault was only 50 percent or less. If you were more than 50 percent at fault, you would be awarded zero damages.
Statute of limitations
This refers to the deadline within which you may file a lawsuit if you decide to take your case to court. In Texas, you have two years after your vehicle accident to file a personal injury lawsuit; after that, the court will likely refuse to hear your case.
This law applies only to lawsuits and not to insurance claims. Further, it does not apply if the party at fault in your accident was a government entity – for example, if you were hit by a city bus. If you are trying to seek compensation from the government, you have to file an administrative claim in as little as 60 days after the accident.
With these rules regarding injury cases, plus the many factors that may be involved in the accident, your personal injury case can get complex. Whether you are claiming from an insurance company or considering filing a lawsuit, it is best to have a competent Houston auto accident attorney on your side to help you succeed.
